Knox County Trial to begin Tuesday, update on Smart and Yoder cases

A trial for Michael Graywolf will begin on Tuesday in Knox County Common Pleas Court. Graywolf is charged with two counts of rape of a child, a count of rape of a child under 13. Graywolf is facing Life in Prison if convicted. Knox County Prosecutor Chip McConville expects the trial to last throughout the week.

Patrick Yoder is charged with aggravated murder in the death of Justin Proper. McConville says Yoder’s defense attorney has filed a motion to see if Yoder is competent to stand trial. He’s also filed a motion to raise the non guilty by reason of insanity defense. The Prosecutor’s are waiting for results of the evaluation on competency. McConville says Yoder could face life without parole as the highest punishment but at minimum it could be 23 years to life. Yoder is not facing the death penalty.

McConville also updated us on a fatal crash that happened on 229 March 22nd. Below is the release

A Howard man was killed and two Mount Vernon men were seriously injured in a one-vehicle crash on Saturday morning, according to the Mount Gilead Post of the Ohio State Highway Patrol.

Tyler J. Schlairet, 34, was a passenger who was ejected from the vehicle and pronounced dead at the scene.

The incident took place on State Route 229 at milepost 7 in Clinton Township at approximately 4:28 a.m.

The Patrol reported that Aaron Bolton, 31, of Mount Vernon was driving and failed to negotiate a curve, driving off the right side of the road and struck a utility pole. Bolton was also ejected from the vehicle. He was transported to Knox Community Hospital and later flown to Grant Hospital in Columbus with life-threatening injuries.

In addition, Landon M. Miller, 19, of Mount Vernon, was a passenger in the vehicle and transported to Knox Community Hospital. He too was later transported to Grant Hospital with serious injuries.

According to the Patrol, alcohol is a suspected factor in the crash.

None of the occupants of the car were wearing a seatbelt, authorities stated.

The Ohio State Highway Patrol was assisted at the scene by the Knox County Sheriff’s Office, the Mount Vernon Police and the Mount Vernon Fire/EMS.

McConville says charges have not been filed yet. McConville says they are waiting for the State Highway Patrol report before making any arrests. McConville says Bolton went off the road and hit a phone pole and the phone pole was taken 8 inches off the ground. An Investigation is ongoing.

McConville also updated on Amy Smart. Smart was charged with Medicaid Fraud. Smart was the Director of Riverside Recovery. Their was a plea deal on the table with Federal Prosecutors and their was a significant amount of restitution in excess of 350,000 dollars to pay back to the Federal Government and she would’ve gotten probation. The Judge in the case rejected the plea deal. A Federal Grand Jury has to accept an indictment in the case.
